Kiss Scholarships Competition Terms and Conditions

To enter, you must read the Kiss Scholarships Competition Rules together with Bauer Radio's Standard Terms and Conditions www.totalkiss.com. You should make sure you read the terms and conditions below and on the link above because your participation constitutes your acceptance of such terms and conditions.

ELIGILBILITY:

  1. Open only to individuals who are legal residents of the United Kingdom.
  2. Participants must be between the ages of 16 and 25. Any contestants younger than 16 years of age must obtain parental consent before entering.
  3. The following individuals are not eligible to enter the Competition employees, contractors, directors and officers of Bauer Radio Limited, Learning Skills Council and each of their respective parent, subsidiaries and affiliated companies, fulfillment, judging and competition agencies involved in the execution of this Competition (collectively, "Competition Parties") or the immediate family members (spouse, parent, child, sibling and spouse or "step" of each) and those living in the same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Competition) of each such employee, contractor, director or officer.

HOW TO ENTER:

To enter the KISS Scholarships Competition, log on to www.totalkiss.com/skills during the Competition Entry Period and click on the 'Scholarships' tab.

Entries must be posted to: KISS Scholarships, Mappin House, 4 Winsley St, London W1W.

Printed submissions as PDF or Word documents Flat Photoshop files and posted to: Kiss Scholarships, Mappin House, 4 Winsley St, London W1W.

Video Submissions as Quicktime on CD or DVD and posted to: Kiss Scholarships, Mappin House, 4 Winsley St, London W1W.

Audio submissions as MP3 120kps on CD and posted to: Kiss Scholarships, Mappin House, 4 Winsley St, London W1W.

All entries must include the name, contact telephone number and address of the person submitting the entry.

Submissions that do not include all required information and adhere to the requirements and terms set out herein will be considered void and will not be considered in the judging of this Competition.

ENTRY REQUIREMENTS:

  1. Your entry must be submitted between Midnight on Sunday 29th June and 6pm on Wednesday 30th July.

  2. Your submission should fulfill the brief , see below:

    • KISS is planning to launch a new monthly club-night. It will feature one daytime DJ and a Kiss specialist DJ as hosts, and will be a mixture of commercial and specialist dance music. WeÕd like to you choose one of the following options and respond to the brief with your work:
    • Sound Design Ð create a sonic identity for the night to be used in promotions on air, and a 1 minute intro for the DJs to use in the club.
    • Video Production - create a 1 minute video to promote the night to listeners online.
    • Web design - design a microsite to promote the monthly clubnight, host a monthly competition to win VIP entry, and a photo gallery
    • Radio Production - write a plan for a radio show to link with the clubnight, outline the content, imaging and feel of the show.
    • A winner will be selected from each category and an overall winner will receive a 'KISS Scholarship'.
  3. Entrants are required to retain their original entry content in the highest possible quality format and will forfeit the right to win if this material is not made available on request.
  4. Submission must be primarily in English.
  5. Once you complete and submit your entry it is final and may not be modified or edited further; however, you may modify the elements of your previous Submission(s) and re-submit them as a new Submission, provided only that the new Submission is materially and substantially different than the previous Submission(s), in KISS' sole discretion.

No Submissions will be returned. Competition Parties may, in their sole discretion, remove, delete and/or disqualify Submissions deemed to be inappropriate or otherwise non-compliant. The person making the Submission will be deemed the participant. The participant is the one (1) person whoÕs details are provided with the Submission.

If any group of individuals elects to collaborate on a Submission, they are required to designate one (1) person as the agent of the group to enter the Competition, and agree to these rules. Neither Kiss nor any of the Competition Parties are liable for any disputes between collaborators arising under or related to the Competition.

Submissions must not contain obscene or indecent material, including but not limited to nudity, pornography or profanity; it must not contain defamatory content, including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group. The Submission must not include threats to any person, place, business, group or world peace; it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations or network standards.

Each Submission must not contain or reference any third party trademarks.

Each Submission must not contain any copyrighted works (other than as owned by the articpant).

In particular, you must hold all rights for any audio and visual content you submit as either your own work or as written consent supplied to you by the owner.

Any elements appearing in your Submission, including without limitation music, audio, speech/voiceovers, stills, video, supers, or other audiovisual materials used must either be entirely original, created and performed by you or you must be able to supply written proof that you own the rights.

Use of any elements, including without limitation music, audio, speech/voiceovers, video, stills, visuals, or other materials that are not original, in the public domain, or not downloaded from the Kiss Life Competition page will result in disqualification of Submission at Kiss' sole discretion.

Any ambiguity over rights will also result in disqualification at the KISS' sole discretion.

Submissions that do not comply with the Official Rules or that otherwise contain prohibited, or inappropriate content as determined by the Kiss, in its sole discretion, will be disqualified and accordingly, will not be considered eligible to win.

KISS makes the final determination as to which submissions are eligible to take part in this competition and be considered to be a winner. Certain submissions may be featured from time to time on www.totalkiss.co.uk or the KISS Scholarships Competition page during the Competition Entry Period. Submissions featured on www.totalkiss.co.uk or the KISS Scholarships Competition page during this time shall bear no correlation to the Judging Criteria or to winner selection.

WARRATIES AND LIABILITY

As conditions of entry into this Competition, and by entering a Submission:

  1. You warrant and represent that you own all rights to the Submission you are entering in this Competition, including without limitation, the video, photography or digital recording, and the performance contained in each Submission.
  2. You warrant and represent that you have obtained permission from each person who appears in the Submission to grant the rights to the Competition Parties described in these rules, and you can make written copies of such permissions available to the Competition Parties please go to www.totalkiss.com/rights to download a form to enable rights to be assigned to you.
  3. You warrant and represent that your Submission(s); (a) are original to the yourself and have been legally obtained and created, (b) do not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws, regulations, or network standards; (c) have not been entered in or won previous competitions or awards; and (d) have not been published previously in any medium.
  4. You irrevocably grant to KISS, the Competition Parties and their affiliates, the unconditional and perpetual right and permission to copyright, reproduce, encode, store, copy, transmit, publish, broadcast, display, publicly perform, adapt and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Participant's Submission in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from the you or any other party.
  5. You irrevocably grant to Kiss and the Competition Parties the right to use your name, address, image, voice, likeness, statements, biographical material and, including, but not limited to the video or digital recording and performances contained in any of the above items (in each case, as submitted or as edited/modified in any way by the Kiss and the Competition Parties), as well as any additional photographic images, video images, portraits, interviews or other materials relating to you and arising out of your participation in this Competition (with or without using the your name) (collectively, the "Additional Materials").
  6. You acknowledge and agree that, if your Submission is chosen as a Winner (as defined in Rule 5 below), that you will execute the necessary documentation to ensure you will have irrevocably assigned and transferred to Kiss any and all rights, title and interest in Submission, including, without limitation, all copyrights, and that you waive all moral rights in your Submission. Any failure do to so will result in your submission being disqualified from the Competition.
  7. You forever waive any rights of privacy, intellectual property rights, and any other legal or moral rights that may preclude the Competition Parties' use of your Submission or Additional Materials, or require your permission for Kiss or the Competition Parties to use them for any purpose, and you agree to never sue or assert any claim against Kiss or the Competition Parties' use of those materials.
  8. You agree to indemnify and hold Kiss and the Competition Parties harmless from any and all claims, damages, expenses, costs (including reasonable legal fees) and liabilities brought or asserted by any third party due to or arising out of the your Submission or Additional Materials in this Competition, or your conduct during and in connection with this Competition, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation.

You acknowledge that these Rules confer certain benefits on the Kiss and that Kiss may enforce such terms of the Rules and that the Contract (Rights of Third Parties) Act 1999 shall apply accordingly.

No liability or responsibility is assumed by Kiss or Competition Parties resulting from any user's participation in or attempt to participate in the Competition or ability or inability to submit any information in connection with participating in the Competition.

No responsibility or liability is assumed by the Kiss or Competition Parties for technical problems or technical malfunction arising in connection with any occurrence which may affect the operation of the Competition including but not limited to: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Competition, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Competition, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Competition.

Use of Web Site is at user's own risk. Kiss and the Competition Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Competition, use of the Web Site or the download of any information from the Web Site.

By participating in the Competition, the Participant releases KISS, Competition Parties from any and all claims, damages or liabilities arising from or relating to such Entrant's participation in the Competition.

By entering the Competition, winners agree that KISS and Competition Parties shall not be liable for any loss or injury resulting from participation in the Competition.

SELECTION CRITERIA

  1. A judging panel consisting of KISS brand experts and selected guest judges from the creative and media world will select the most original and creative pieces which best respond to the brief. These entrants will be deemed ÔwinnersÕ and their work could be showcased online.
  2. Finalists will be selected by the judging process in which the panel of judges will evaluate each eligible Submission based on the judging criteria.
  3. The entries finalists will be revealed on www totalkiss.com on Monday 4th August
  4. All Finalists are subject to verification, including without limitation, verification of eligibility, compliance with the Competition Rules and completion of necessary documentation.
  5. If attempted notification is returned as undeliverable, if a Finalist cannot be verified, or if a Finalist is otherwise uncontactable a new winner will be selected at the Kiss' discretion.
  6. Entrants agree that the KISS has the sole right to decide all matters and disputes arising from this Competition and that all decisions of Kiss are final and binding.
  7. The winner by accepting the prize as a ÔWinnerÕ agree to release, indemnify and hold harmless the Competition Parties from any and all liability, loss, damage, cost or claim relate to any allegation regarding the acceptance or use of their prize.

GENERAL CONDITIONS:

  1. Finalists will be notified by phone and/or mail .
  2. Notification of winning status must be kept confidential until the Winner(s) are publicly revealed by Kiss. In the event the Winner releases any information regarding this Competition into the public domain the Winner will be disqualified and an alternative winner will be selected.
  3. If for any reason the Competition process must be adjusted in situations including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition, Kiss reserves the right, at its sole discretion to cancel, modify or terminate the Competition.
  4. KISS reserves the right, at its sole discretion, to disqualify any individual deemed to be:
    1. tampering or attempting to tamper with the entry process or the operation of the Competition;
    2. violating the Official Rules;
    3. acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
  5. Kiss reserves the right to require a potential Finalist to submit to a confidential background check to confirm eligibility and help ensure that such person will not bring Competition Parties into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Competition as determined by Kiss in its sole discretion.

JURISDICTION:

Our terms and conditions shall be governed by and constructed in accordance with English law. You agree to submit to the exclusive jurisdiction of the courts of England.
